Terms of Service

These Terms of Service ("Terms") form a legal agreement between you and Vibseek GbR (Aleksander Banjanin Morato and Francois Wurmus), Colbestr 29, 10247 Berlin, Germany ("Vibseek," "we," "our," or "us").

By accessing our website, joining a waitlist, downloading samples, or installing or using Vibseek Studio or Vibseek MusicMapper, you agree to these Terms. If you do not agree, do not use the products or related services.

These Terms are intended for creators and consumers. If mandatory law in your jurisdiction gives you additional rights, those rights continue to apply.

Vibseek currently operates a small portfolio of products with different technical models:

• Vibseek Samples: a cloud-based experience for curated sample discovery, listening, and downloads.
• Vibseek Studio: local software that runs on your device and is designed to work alongside your DAW.
• Vibseek MusicMapper: local software that runs on your device for music-related workflow and exploration features.

These Terms cover the current live or current-portfolio state of those products. They do not create obligations around future marketplaces, paid subscriptions, seller tools, or enterprise services that are not yet live.

• You may use the products only for lawful purposes and in compliance with applicable laws, regulations, and third-party rights.
• You may not reverse engineer, interfere with, disrupt, or attempt unauthorized access to Vibseek systems except where mandatory law clearly permits it.
• You may not upload, transmit, or submit harmful code, malware, or unlawful material to Vibseek.
• You remain responsible for your creative decisions, your local files, your backups, and the lawful use of any content you create with or alongside Vibseek products.

When Vibseek makes curated sample content available for download, Vibseek grants you a limited, non-exclusive, non-transferable license to use those downloaded sample files in your own musical, audiovisual, and commercial creative projects on a royalty-free basis, unless a specific asset page clearly states otherwise.

You may not:

• resell, sublicense, or redistribute raw sample files;
• rehost, mirror, upload, or share the downloaded files as a standalone library, pack, or competitive product;
• claim ownership over Vibseek's original sample files as such; or
• use the content in a way that violates law, third-party rights, or these Terms.

This license is limited to the sample content made available by Vibseek. It does not transfer Vibseek's intellectual property rights in the underlying files, branding, or platform.

Subject to these Terms, Vibseek grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use Vibseek Studio and Vibseek MusicMapper on devices you control for lawful personal or professional creative use.

• The software is licensed, not sold.
• You may not copy, resell, rent, lease, sublicense, or make the software available to third parties except as expressly allowed by us in writing.
• You may not remove proprietary notices or use the software in a way that breaches export controls, sanctions laws, or applicable platform rules.
• We may suspend, revoke, or change access to beta builds, preview features, or related services if necessary for security, maintenance, or product changes.

As of May 11, 2026, Vibseek's current public products are offered on a free or beta basis. We do not currently offer live recurring paid subscription plans through these public products.

We may change, pause, limit, or discontinue features, products, betas, or access at any time. Vibseek is not providing a service level agreement, guaranteed uptime commitment, or guaranteed release schedule at this stage.

If Vibseek later launches paid plans, subscriptions, or other billable offerings, the applicable billing, cancellation, renewal, withdrawal, and refund terms will need to be disclosed and updated before those offerings go live.

Some Vibseek experiences may include AI-assisted search, discovery, mapping, recommendation, or workflow features. These features are intended to support creative work, not replace your judgment.

• AI-assisted outputs, categorizations, or recommendations may be incomplete, incorrect, or unsuitable for your specific use case.
• You remain responsible for reviewing and validating any output, sample choice, workflow suggestion, or project decision.
• Vibseek may update, retrain, replace, or remove experimental features without notice.

Vibseek and its licensors retain all rights, title, and interest in the Vibseek website, software, branding, design, sample catalog structure, and related materials, except for rights expressly granted to you in these Terms.

If you send feedback, ideas, bug reports, or feature requests to Vibseek, you allow us to use them without restriction or compensation, unless mandatory law says otherwise.

To the maximum extent permitted by law, the products and related services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.

• We do not warrant uninterrupted availability, compatibility across every operating system, DAW, plugin, hardware setup, or future configuration.
• We do not warrant that the products are error-free, secure, or free from harmful components.
• We do not warrant that any use of the products will preserve files, settings, sessions, sample libraries, or project data.
• You are responsible for maintaining backups and protecting your local files, software environment, and hardware setup.

To the maximum extent permitted by applicable law, Vibseek will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, goodwill, use, data, projects, software configurations, or hardware functionality arising from or related to the products or these Terms.

This includes, for example, loss or corruption of creative project data, local file damage, device downtime, operating system issues, DAW or plugin conflicts, or failures caused by your environment, third-party tools, unsupported setups, or experimental features.

To the maximum extent permitted by law, Vibseek's total aggregate liability for claims arising out of or relating to the products or these Terms will not exceed EUR 100 or the amount you paid directly to Vibseek for the relevant product in the 12 months before the event giving rise to the claim, whichever is higher.

Nothing in these Terms excludes or limits liability where such exclusion is not permitted by law, including liability for fraud, willful misconduct, gross negligence where non-waivable law says so, death or personal injury caused by negligence where non-waivable law says so, or any mandatory consumer rights.

We may suspend or terminate access to the website, downloads, waitlists, betas, or software-related services if you breach these Terms, create security risk, misuse the products, or where we reasonably need to protect Vibseek, users, or third parties.

Upon termination, the licenses granted under these Terms end except to the extent mandatory law or an expressly granted sample content license requires otherwise. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimer, liability, and dispute sections.

These Terms are governed by the laws of Germany, excluding its conflict-of-laws rules, unless mandatory consumer protection law in your place of residence gives you additional protection that cannot be waived by contract.

If you are acting as a business, the exclusive place of jurisdiction for disputes arising out of or in connection with these Terms is Berlin, Germany. If you are a consumer, mandatory rights to bring claims in other competent courts remain unaffected.

We may update these Terms from time to time to reflect product changes, legal requirements, or operational needs. The updated version will be posted on this page with a new "Last updated" date.

If a change is material, we will use a reasonable method of notice appropriate to the product and relationship involved, such as the website, email, or in-product messaging where available.
